Therefore you must know how to fire an at will worker appropriately to limit your legal liability. Once everything is ready for the meeting, it's time for the termination. Otherwise, you find yourself in the middle of a wrongful termination suit. Second, make sure no supervisor fires a worker without giving a reason. Remember when writing your own letter, you must obviously express why you are terminating the worker. Often in large corporations, layoffs include early retirement packages to long-term employees. At times an employee becomes a liability the business can't afford to support. They only come to the home office a few times a year.
Your Personnel department may have a procedure for tracking FMLA leave which you and the employee should use. This is true whether you're an Hr supervisor or small company owner who must deal with personnel issues. Please don't use 'downsizing' as an excuse for dismissing insubordinate employees, or creating a culture change in the organization by replacing old personnel with new ones. You and the employee should sign all written documents to show the jobholder knew of the possible separation.
